Welcome to Zen Within LLC (“Zen Within,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website zenwithin.io, our mobile application (“Zen Within App”), and any other services we provide (collectively, the “Services”). 

By accessing or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our Services. 

 

Overview of Zen Within 

Zen Within is a wellness applicaiton and website that provides tools for guided meditation, journaling, mood tracking, and task management. We offer a variety of plans to meet your wellness needs, including a Free Plan with limited access and paid subscription plans with enhanced features. 

 

 

1. Eligibility

You must be at least 18 years of age to use our Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. 

 

2. Account Registration

You may need to create an account to access certain features of the Services. You agree to: 

• Provide accurate and complete information. 

• Maintain the security and confidentiality of your login credentials. 

• Notify us immediately of any unauthorized use or suspected breach. 

You are solely responsible for all activities occurring under your account. 

 

3. License to Use the App and Website

Subject to these Terms, Zen Within grants you a limited, non-exclusive, non-transferable, and revocable license to download, install, and use the Zen Within App or access our website solely for personal, non-commercial use. 

You may not: 

• Copy, modify, or create derivative works. 

• Reverse-engineer, decompile, or attempt to extract source code. 

• Sell, lease, or sublicense the Services. 

• Use the Services for unlawful or harmful purposes. 

 

4. Subscription and Payment Terms

Some features of the Zen Within App may require a paid subscription. By purchasing a subscription, you agree to: 

• Pay applicable fees (one-time, recurring, or promotional). 

• Automatic renewal unless canceled before the billing date. 

• Abide by the payment terms of the platform used (Apple App Store or Google Play). 

We do not process payments directly. Payment transactions are handled securely by third-party processors, and their terms govern those transactions. 

 

5. User Conduct and Content

You agree not to: 

• Post or transmit any unlawful, defamatory, obscene, or harmful content. 

• Harass, abuse, or harm another person. 

• Attempt to gain unauthorized access to our systems or data. 

• Use automated tools (bots, scrapers) without written consent. 

You retain rights to the content you submit (e.g., journal entries, comments), but you grant Zen Within a non-exclusive, royalty-free license to use, display, and store such content solely for operating the Services. 

 

6. Disclaimers

6.1 No Medical Advice 

Zen Within is a wellness platform, not a medical or mental health service provider. Our app content (meditations, prompts, wellness tools) is for informational and self-care purposes only and is not a substitute for professional medical or psychological advice. 

If you are experiencing a crisis, call 911 or contact a licensed mental health professional. 

6.2 No Guarantees 

We make no warranties or guarantees that the Services will be uninterrupted, error-free, or meet your expectations. 

Services are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, either express or implied. 

 

7. Limitation of Liability

To the maximum extent permitted by law, Zen Within LLC, its officers, employees, or agents shall not be liable for: 

• Indirect, incidental, or consequential damages; 

• Loss of data, revenue, or goodwill; 

• Damages exceeding the amount you paid for the Services in the 12 months preceding the claim. 

 

8. Third-Party Links and Services

Our Services may contain links to third-party websites or platforms (e.g., YouTube, payment processors). We are not responsible for the content, policies, or practices of any third party and encourage you to review their terms. 

 

9. Intellectual Property

All content, trademarks, logos, graphics, and software used in the Services are the property of Zen Within or its licensors and are protected by intellectual property laws. 

You may not use, copy, or distribute our intellectual property without our written consent. 

 

10. Termination

We reserve the right to suspend or terminate your account or access to the Services if you violate these Terms, misuse the platform, or engage in unlawful behavior. 

Upon termination, your license is revoked and access to your account may be disabled or deleted. 

 

11. Modifications to the Terms

We may update these Terms from time to time. Changes will become effective upon posting. If the changes are material, we will notify you via email, push notification, or prominently on our platform. 

Your continued use after the effective date constitutes your acceptance. 

 

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. 

Any legal disputes shall be resolved in the courts of Contra Costa County, California.
